OPERATING CONDITIONS

1. General

The present conditions of sale are concluded on the one hand :

- by the micro-enterprise - Rémi Lavocat - whose head office is located in France, 2 route de colonozet 39190 CHEVREAUX, and registered under the SIRET number: 509 810 263 00038, hereinafter referred to as "Artisanya", 

- and on the other hand, by any individual or legal entity, hereinafter referred to as "the buyer", wishing to make a purchase on the website of "www.artisanya.com", hereinafter referred to as "the merchant site" or "the site".

These terms and conditions of sale are intended to define the contractual relationship between Artisanya and the buyer and the conditions applicable to any purchase made through the merchant site of "www.artisanya.com", whether the buyer is a professional or a consumer. The acquisition of a good or service through the site implies the unreserved acceptance of these terms and conditions of sale. The buyer therefore declares to have taken knowledge of them at the time of placing his order.

These terms and conditions may be modified at any time without notice by Artisanya. However, these modifications will only be applicable to orders made after they have been placed online. These terms and conditions of sale will prevail over any other general or special conditions not agreed to by Artisanya.

2. Products

All the creations proposed by Artisanya are handmade creations. Therefore, each of them is unique, and the product ordered may differ slightly from the photo presented on the site. The photos are non-contractual and are only suggestions for presentation.

Each item is offered within the limits of available stocks. You will find in each description information on the availability of the product.

In the event of an order for a single product that has already been sold - in the event of an error in the operation of the shop if two orders are placed simultaneously before the automatic stock update, for example -, the customer who ordered the item first, date and time of the order being taken as proof, will see his order validated alone. The second will be refunded his order or offer an equivalent product if existing.

3. Prices

The prices displayed on the site are prices in euros including all taxes. They do not take into account the delivery costs, invoiced in supplement, and indicated at the time of the finalization of the order. Artisanya reserves the right to modify its prices at any time, in particular due to variations in the prices of its own suppliers. However, it is understood that the price shown in the catalogue on the day of the order will be the only one applicable to the buyer.

4. Orders, withdrawal and returns

Artisanya reserves the right to cancel any order from a buyer with whom there is a prior dispute. All orders are irrevocable for the buyer subject to the application of the legal withdrawal period of 14 working days (Hamon law) following the delivery date of his order, in accordance with article L. 121-21 of the Consumer Code. The buyer has this period to return any item that does not suit him/her and request an exchange or reimbursement without penalty, except for the return costs which will be at his/her own expense.

It is then necessary to make an unambiguous statement expressing the willingness to withdraw (Article L. 121-21-2 of the Consumer Code). An acknowledgement of receipt will be sent to the buyer as soon as possible (email or mail) to inform him of the good receipt of his request for withdrawal.

Reimbursement of the good(s) will be made within 14 days of receipt of the withdrawal form, by the same means of payment as that used by the buyer to pay for his order, or by another means of payment after agreement of the buyer. Reimbursement may be deferred until Artisanya receives proof of reshipment of the goods by the buyer: Colissimo slip, tracked letter slip or any other shipping method allowing tracking of the package.

The return costs are at the expense of the buyer, the shipment must be made under shipping conditions similar to those previously used by Artisanya to ship the package. Items must be complete, intact and unopened, always in their original packaging. The buyer undertakes to return the products within 14 days of being informed of his decision to withdraw, unless Artisanya offers to collect the goods itself (article L. 121-21-3 al. 1 of the Consumer Code).

The buyer may test the product but will be liable for any depreciation of the goods resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the goods (Article L. 121-21-3 al. 3 of the Consumer Code).

For any item made to measure with the customer's choice of options, the right of withdrawal may not apply, in accordance with the provisions of Article L 121-20 of the Consumer Code as amended by Order No. 2001-741 of 23 August 2001. Withdrawal is notably excluded (article 121-20.2 paragraph 3) for contracts for the supply of goods that are clearly personalised or made to the consumer's specifications, including made-to-measure items. Personalised articles made to order will therefore not be exchanged, taken back or refunded.

By confirming his order, the buyer accepts the entirety of these general terms and conditions of sale, and acknowledges having perfect knowledge of them and renouncing the right to invoke his own terms and conditions of purchase or other conditions. All the data provided and the recorded confirmation will be worth proof of the transaction and acceptance of the operations carried out.

The online sale of Artisanya products is intended for buyers from all over the world. Additional shipping charges may apply depending on the destination. In case of doubt, do not hesitate to contact us.

In case of non-payment of the order within 2 (two) weeks following the placing of the order on the website, the order will be considered void and will be automatically cancelled.

5. Methods of payment

The payment of the purchases is done as soon as the order is finalized. Payments are made either :

- By bank cheque: payment valid only for holders of a bank account domiciled in France. The payment information will be communicated to you at the time of the finalization of your order. In case of payment by cheque, the cheque must be accompanied by the corresponding order number (provided during the validation of the order), in order to process your shipment as soon as possible.

- By Paypal - immediate and highly secure electronic payment interface, using your Paypal account. In this case, you must have a Paypal account to pay for your purchases. For more information, please visit www.paypal.fr . Valid for all customers, French or foreign.

- By bank transfer: The payment information will be communicated to you when your order is finalized. Valid for all customers, French or foreign.

For any other method of payment (postal order, hand-delivered payment, etc.), please contact us before placing your order in order to agree on the terms of payment.

6. Delivery

Details of shipping options:

Collection from our workshop: - This shipping option is of course free of charge. Once your order is complete, please let us know your date and time so that we can make arrangements. After confirmation from us, you can then come and pick up your item at our workshop located: 2, route de Colonozet, 39190 à Chevreaux. 

Tracked Letter - The indicative time for sending a Tracked Letter in metropolitan France is about 2 days (48 hours) and about 3 days for the main European cities (indicative times) For more comfort, the different stages of tracking are accessible 24 hours a day and the information is available for 60 days. Attention, this type of shipment is for shipments that do not exceed 3 cm and 3 kg.

Colissimo Domicile - without signature

Once the package has been prepared by us, it will be delivered to you within 48 hours, directly to your mailbox. If this one is not big enough and you are absent, a delivery notice will be left with you allowing you to choose on the Internet a new delivery date within 6 working days or to pick up your parcel the next day at 3pm in the post office of your choice.

If you do not express a choice, you will be able to recover your parcel in your home post office within 15 days.

Colissimo Domicile - with signature

Once the package has been prepared by us, it will be delivered to you within an indicative period of 48 hours and given to you against signature. If you are absent, a delivery notice will be left with you, allowing you to choose a new delivery date on the Internet within 6 working days or to pick up your package the next day at 3pm at the post office of your choice.

If you do not express a choice, you can then collect your package in your home post office within 15 days.

Colissimo Point Withdrawal

With Colissimo Point Withdrawal you can choose from several methods of withdrawal to retrieve your package

- At La Poste, you can choose the establishment in which you wish to be delivered (without first passing your invoice at home) from among the 8,000 post offices available throughout metropolitan France.

Once the package has been prepared by us, it will be delivered to you within an indicative period of 48 hours and you will be informed of the availability of your package by SMS and e-mail. You can then come and collect it within 10 working days. After this period, your package will be returned to us.

- in Pickup Relay, you can choose one of the 9500 local retailers in the Pickup network, near your home, your workplace or your holiday destination, to which you would like to have your parcel delivered.

Once the package has been prepared by us, it will be delivered to you within an indicative period of 48 hours and you will be informed of the availability of your package by SMS and e-mail. You can then come and collect it within 10 working days. After this period, your package will be returned to us.

- in Pickup Station, you can choose one of the 500 automatic pick-up locations to have your parcel delivered. Set up on your route (train station, metro, car park, shopping centres...) they are accessible 7 days a week and 24 hours a day (except deposits subject to the opening hours of shopping malls and transport zones).

Once the package has been prepared by us, it will be delivered to you within an indicative period of 48 hours and you will be informed of the availability of your package by SMS and e-mail. The latter will give you your withdrawal codes allowing you to collect your package during 3 working days. After this period, your package will be returned to us.

The standard national shipping method is Colissimo or Lettre suivie (depending on the size and weight of the items shipped), delivered without signature. An additional cost will be applied in case of registered mail or delivery against signature. Artisanya undertakes to transmit the tracking number of the package as soon as possible to the buyer via an automatic communication via the buyer's customer account. It is also possible to opt for an economical shipment without a tracking number, at a low price (bubble mail at letter rate).

Additional charges may apply in the case of international shipping (outside metropolitan France). The shipping costs applied on the site do not take into account possible customs charges or taxes relating to the country of destination, which remain the responsibility of the buyer.

Shipping costs include packaging, handling and postage. They contain a fixed part of 1€, corresponding to handling and packaging costs (cardboard, bubble wrap, foam etc.) and a variable part depending on the price or weight of the order. It is advisable to group your purchases into a single order to reduce costs. Artisanya will not be able to group two separate orders and the buyer will have to pay shipping costs for each of them.

The package is shipped at the buyer's risk. Packages are oversized and protected and particular care is taken with packages containing fragile products. However, Artisanya cannot be held responsible for any damage that may occur during transport, after the package has been deposited by Artisanya at the post office.

Unless otherwise specified, delivery is made to the address indicated by the buyer when ordering. In case of error on the part of the buyer in the wording of the addressee's details, Artisanya cannot be held responsible for the impossibility of delivering the product to its destination. Additional costs related to a possible reshipment - in case of return of the package - are at the expense of the buyer.

Artisanya undertakes to inform the buyer by email of the manufacturing and delivery details of his purchase as soon as the order has been fully completed and payment has been credited to the seller.

In case of damage during transport, a claim must be made to the carrier upon receipt of the shipment. Artisanya cannot be held responsible for any damage, loss or theft of packages by the carrier. In case of loss of the package, no refund or return will be considered if the delivery chosen was the economic mode. This method of delivery does not offer any guarantee. The tracked delivery method allows you to track your package during its delivery. In the event of a problem relating to this delivery, loss or theft, a new package will be sent to you if the items are still available or a refund will be made to you if they are unique items or non-reproducible copies. Please note that no package will be returned or refunded if the tracking site indicates that the package has been delivered to its recipient. Parcel return or refund will only apply in the event of a problem with the delivery, expressly indicated on the tracking site.

7. Delivery times

Unless otherwise stated (email expressly sent to the buyer or message of absence announced on the site), shipments are generally made within 3 to 5 days from receipt of payment and validation of the order, depending on the availability of products and their duration of preparation.

8. Warranty for standard products and services

In case of non-conformity of a product sold, the product may be returned to Artisanya, which will take it back, exchange it or refund it according to the agreement between Artisanya and the buyer. The buyer is solely responsible for the choice of products, their conservation and use. Artisanya cannot be held responsible for damages of any kind, whether material, immaterial or corporal, which may result from the misuse of the products sold.

Artisanya will not be considered responsible or liable for any delay or non-performance due to the occurrence of a case of force majeure usually recognized by French jurisprudence (unavailability of the product, force majeure, disruption or total or partial strike of postal services and means of transport and / or communications, flood, fire).
